Overview
Welcome to Happy Face Market! This website, happyfacemarket.com (the “Storeâ€), is operated by Happy Face Market (“we,†“us,†or “ourâ€), a small business based in Indiana. When we say “you,†we mean anyone who visits the Store or buys from it.
By visiting the Store or buying from us, you agree to these Terms of Service (the “Termsâ€), along with our Refund Policy and Privacy Policy. Please read them carefully. If you don't agree, please don't use the Store.
We've tried to keep these Terms in plain English. If you have a question about any part of them, email us at info@happyfacemarket.com.
1. Online store terms
To use the Store or buy from us, you must be the age of majority where you live, or have the permission of a parent or guardian who agrees to these Terms on your behalf.
You agree not to use the Store or our products for anything illegal or unauthorized, and not to break any laws (including copyright laws) while using the Store. You also agree not to send us viruses or any other harmful code. Breaking any of these Terms may lead to your access being ended right away.
If you create an account, you're responsible for keeping your login secure and for everything that happens under your account.
2. Accuracy of information
We try hard to keep the Store's information correct and up to date, but we can't promise it's always complete or current. Information on the Store is for general purposes only. We may update content at any time, but we're not obligated to.
Sometimes there may be typos, mistakes, or omissions in product descriptions, prices, promotions, shipping times, or availability. We reserve the right to correct errors, to update information, and to cancel orders affected by an error, even after you've placed your order. If we cancel your order, we'll refund what you paid.
3. Pricing and changes to the Store
Prices are listed in US dollars and can change without notice. We may change, pause, or discontinue any part of the Store (or any product) at any time. We won't be responsible to you or anyone else for price changes, pauses, or discontinued products.
4. Products
Our products include apparel (tees, crewnecks, sweatshirts, and quarter-zips in adult, youth, and toddler sizes), stickers, and pins. Some items may be available only in limited quantities or for a limited season. Returns are covered by our Refund Policy.
We do our best to show product colors and images accurately. However, your screen may not show colors exactly, and printed details can vary a little from item to item. Please check the size information before ordering.
We may limit sales of any product to any person, household, or region, and we may limit quantities. We don't promise that every product will meet your expectations, or that any mistakes in the Store will be corrected.
5. Orders and billing
When you place an order, you're making an offer to buy. We may accept or decline any order. We may also limit or cancel quantities bought per person, per household, or per order, including orders placed with the same account, card, or billing or shipping address. If we change or cancel your order, we'll try to let you know using the email or billing address you gave us, and we'll refund any amount charged.
You agree to give us current, complete, and accurate purchase and account information, and to update it when needed (including your email and card expiration date), so we can complete your order and contact you.
Applicable sales tax is calculated and shown at checkout. Shipping costs and estimated delivery times are shown at checkout. We currently ship only within the United States. Risk of loss passes to you when your order is handed to the carrier.
6. Intellectual property
The Store and everything on it are owned by Happy Face Market or its licensors and are protected by copyright, trademark, and other laws. That includes our designs, artwork, logos, the Happy Face Market name, text, and photos. Buying a product lets you use and enjoy that product. It doesn't give you the right to copy, reproduce, or resell our designs.
7. Third-party tools and links
The Store runs on Shopify. Payments, shipping, and some other features may be provided by third parties. Some content or links on the Store may come from third parties or lead to their websites. We don't control, and aren't responsible for, third-party websites, content, products, or services. Please read a third party's terms and policies before you use them. Any problems with third-party products or services should be taken up with that third party.
8. User comments, feedback, and reviews
If you send us ideas, suggestions, reviews, or other comments (by email, on social media, or on the Store), you agree we may use, edit, copy, publish, and share them in any form, without owing you anything and without having to keep them confidential.
We may (but don't have to) monitor, edit, or remove content we think is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates someone else's rights or these Terms. You're responsible for anything you post. You agree not to post anything false, unlawful, abusive, or that contains viruses, and not to pretend to be someone else.
9. Personal information
When you submit personal information through the Store, our Privacy Policy applies. It explains what we collect and how we use it. You can find it linked in the Store's footer.
10. Prohibited uses
In addition to the other rules in these Terms, you may not use the Store or its content:
- For any unlawful purpose, or to encourage others to do anything unlawful
- To violate any law or regulation
- To infringe our intellectual property or anyone else's
- To harass, abuse, insult, harm, defame, or discriminate against anyone
- To submit false or misleading information
- To upload or send viruses or other harmful code
- To collect or track other people's personal information
- To spam, phish, scrape, or crawl the Store
- For any obscene or immoral purpose
- To interfere with or get around the Store's security features
We may end your use of the Store if you break any of these rules.
11. Disclaimer of warranties and limitation of liability
We work hard to keep the Store running smoothly, but we can't promise it will always be available, uninterrupted, secure, or error-free. Except where the law says otherwise, the Store and all products are provided “as is†and “as available,†without warranties of any kind, express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing here limits any rights you have under our Refund Policy.
To the fullest extent the law allows, Happy Face Market and its owners, employees, and suppliers won't be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost data, or similar losses, arising from your use of the Store or any product. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states don't allow certain of these limits. Where that's the case, our liability is limited as much as the law permits.
12. Indemnification
You agree to defend, indemnify, and hold harmless Happy Face Market and its owners, employees, and suppliers from any claim or demand (including reasonable attorneys' fees) made by a third party because you broke these Terms or the law, or violated someone else's rights.
13. Severability
If any part of these Terms is found to be unlawful, void, or unenforceable, that part will be enforced as far as the law allows. The rest of the Terms will remain in full effect.
14. Termination
These Terms apply until either you or we end them. You can end them at any time by no longer using the Store. If we believe you've broken these Terms, we may end them, or your access to the Store, at any time and without notice. You'll still owe any amounts due up to that point. Sections that by their nature should survive (like intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
15. Entire agreement
These Terms, together with our Refund Policy, Privacy Policy, and any other policies posted on the Store, are the entire agreement between you and us about your use of the Store. They replace any earlier agreements or communications. If we don't enforce a right or provision of these Terms, that doesn't mean we've waived it.
16. Governing law
These Terms are governed by the laws of the State of Indiana and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts in Hamilton County, Indiana, and you agree to those courts' jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. The current version is always on this page, and the “Last updated†date at the top shows when it last changed. It's your job to check for updates. If you keep using the Store after changes are posted, that means you accept the new Terms.
